11. In 1969, Union Carbide Corporation a
multinational enterprise in the chemical industry
headquartered in Danbury, connectient, selected Bhopal
as the site for its new pesticide plant in India. Twenty
years later, this was to be the location of the worst

industrial accident in history. Over three thousand
people were killed and scores of thousands left
permanently injured as a toxic chemical gas enveloped
forty square kilometers around the plant. Years after the
accident, despite intensive analysis of the events leading
to the disaster and numerous court battles, some
fundamental questions remain unanswered. Who was at
fault UCC or its subsidiary union cabide of India Limited
Was there negligence on the part of the
management of the plant? What was the extent and
nature of the cross-border liability of the parent
company, UCC and how, if at all, is it responsible for the
actions of its subsidiary UCIL?
