G.S.R. ---In exercise of the powers conferred by section 18 of the Central Reserve Police Force Act, 1949 (66 of 1949), the Central Government hereby makes the following rules regulating the method of recruitment to Group A posts in Engineering Wing of the Central Reserve Police Force, under the Ministry of Home Affairs, namely :

1. Short title and commencement. ---(1) These rules may be called the Central Reserve Police Force, Engineering Officers (Group A Posts) Recruitment Rules, 2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

  1. Application. -These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

    1. Government means the Government of India;

    2. Scheduled Castes, and Scheduled Tribes shall have the same meanings as

    1. Definitions. --In these rules, unless the context otherwise requires,-

assigned to them in clauses (24) and (25) respectively of article 366 of the

Constitution;

(c) words and expressions used herein but not defined, shall have the meanings respectively assigned to them in the Central Reserve Police Force Act, 1949 and the Central Reserve Police Force Rules, 1955.

4. Number of posts, classification and level in the pay matrixThe number of posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to

(4) of the aforesaid Schedule.

5. Method of recruitment, age-limit, qualifications, etc. -The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns

(5) to (13) of the said Schedule.

6. Initial constitution -

(1)
Officers holding posts mentioned in the Schedule on the date of commencement of these rules on regular basis, shall be deemed to have been appointed in accordance with the provisions of these rules.
(2)
The regular continuous service of officers referred in sub-rule (1) in the respective grades immediately before commencement of these rules shall be taken into account for the purpose of probation period, qualifying service for promotion, confirmation and pension in the service.

7. Seniority. -(1) All officers holding a higher rank shall be senior to officers holding a lower rank.

(2) Seniority of officers appointed to any post in a particular rank shall be determined in accordance with the orders of the Government issued from time to time.

  1. Appointment. ---Officers who have completed their qualifying or eligibility service as prescribed in the Schedule annexed to these rules, shall only be considered for appointment or promotion or deputation to the grade or grades provided they are in Medical Category SHAPE-I as specified under the Standing Order No. 04 of 2008 dated 15th December, 2008 and subsequent amendments issued by the Directorate General, Central Reserve Police Force from time to time.

  2. Liability of service. -A person appointed to any category of posts under these rules shall be liable to serve anywhere in India or abroad.

  3. Other conditions of service. -The Central Reserve Police Force Act, 1949 (66 to 1949) and the Central Reserve Police Force Rules, 1955 shall be applicable to the persons appointed under the provision of these recruitment rules in respect of conditions of service not specifically provided for in these recruitment rules.

    1. Who has entered into or contracted marriage with a person having spouse living or

    2. Who having a spouse living has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the said posts provided :

    1. Disqualification ---No person

that the Central Government may, if satisfied that such marriage is permissible under the
personal law applicable to such person and the other party to the marriage and that there are
other grounds for so doing, exempt any person from the operation of this rule.
12. Ineligibility of aliens.---No person who is not a citizen of India shall, except with the prior
permission of the Central Government in writing, be appointed, under these rules :
Provided that nothing contained in these rules shall bar the appointment or
employment of a subject of Nepal, or Bhutan under these rules.
13. Superannuation. ---The officers holding the posts higher than that of the Commandant and
above shall retire from service on the afternoon of the day of the month in which they attain
the age of sixty years, and other officers shall retire from service on the afternoon of the last
day of the month in which they attain the age of fifty seven years :
Provided that an officer whose date of birth is the first of a month shall retire from
service on the afternoon of the last day of the preceding month, on attaining the age of sixty
years or fifty seven years, as the case may be.
14 Power to relax. -Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
15 Saving. ---Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Such persons would be given deputation terms up to the date on which they are due to release from Armed Forces; thereafter they may be continued on re-employment. Note : The maximum age limit for eligibility for re-employment shall be not exceeding fifty-six years on the date of receipt of application.

Note: 1 Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service. 1. Short title and commencement. ---(1) These rules may be called the Central Reserve Police Force, Engineering Officers (Group A Posts) Recruitment Rules, 2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

  1. Application. -These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

    1. Government means the Government of India;

    2. Scheduled Castes, and Scheduled Tribes shall have the same meanings as

    1. Definitions. --In these rules, unless the context otherwise requires,-

assigned to them in clauses (24) and (25) respectively of article 366 of the

Constitution;

(c) words and expressions used herein but not defined, shall have the meanings respectively assigned to them in the Central Reserve Police Force Act, 1949 and the Central Reserve Police Force Rules, 1955.

4. Number of posts, classification and level in the pay matrixThe number of posts, their classification and level in the pay matrix attached thereto shall be as specified in columns (2) to

(4) of the aforesaid Schedule.

5. Method of recruitment, age-limit, qualifications, etc. -The method of recruitment, age limit, qualifications and other matters relating to the said posts shall be as specified in columns

(5) to (13) of the said Schedule.

6. Initial constitution -

(1)
Officers holding posts mentioned in the Schedule on the date of commencement of these rules on regular basis, shall be deemed to have been appointed in accordance with the provisions of these rules.
(2)
The regular continuous service of officers referred in sub-rule (1) in the respective grades immediately before commencement of these rules shall be taken into account for the purpose of probation period, qualifying service for promotion, confirmation and pension in the service.

7. Seniority. -(1) All officers holding a higher rank shall be senior to officers holding a lower rank.

(2) Seniority of officers appointed to any post in a particular rank shall be determined in accordance with the orders of the Government issued from time to time.

  1. Appointment. ---Officers who have completed their qualifying or eligibility service as prescribed in the Schedule annexed to these rules, shall only be considered for appointment or promotion or deputation to the grade or grades provided they are in Medical Category SHAPE-I as specified under the Standing Order No. 04 of 2008 dated 15th December, 2008 and subsequent amendments issued by the Directorate General, Central Reserve Police Force from time to time.

  2. Liability of service. -A person appointed to any category of posts under these rules shall be liable to serve anywhere in India or abroad.

  3. Other conditions of service. -The Central Reserve Police Force Act, 1949 (66 to 1949) and the Central Reserve Police Force Rules, 1955 shall be applicable to the persons appointed under the provision of these recruitment rules in respect of conditions of service not specifically provided for in these recruitment rules.

    1. Who has entered into or contracted marriage with a person having spouse living or

    2. Who having a spouse living has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the said posts provided :

    1. Disqualification ---No person

that the Central Government may, if satisfied that such marriage is permissible under the
personal law applicable to such person and the other party to the marriage and that there are
other grounds for so doing, exempt any person from the operation of this rule.
12. Ineligibility of aliens.---No person who is not a citizen of India shall, except with the prior
permission of the Central Government in writing, be appointed, under these rules :
Provided that nothing contained in these rules shall bar the appointment or
employment of a subject of Nepal, or Bhutan under these rules.
13. Superannuation. ---The officers holding the posts higher than that of the Commandant and
above shall retire from service on the afternoon of the day of the month in which they attain
the age of sixty years, and other officers shall retire from service on the afternoon of the last
day of the month in which they attain the age of fifty seven years :
Provided that an officer whose date of birth is the first of a month shall retire from
service on the afternoon of the last day of the preceding month, on attaining the age of sixty
years or fifty seven years, as the case may be.
14 Power to relax. -Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.
15 Saving. ---Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
