RECRUITMENT OF CANDIDATES TO THE POST OF CIVIL JUDGES

LAST DATE FOR ONLINE RECEIPT OF APPLICATIONS: 01.03.2017

It is hereby notified that under the provisions of Karnataka Judicial Service (Recruitment) Rules, 2004 and Amendment Rules, 2011 and 2015, the High Court of Karnataka invites Online applications for direct recruitment to 167 posts of Civil Judges [the then Civil Judge (Junior Division)] which includes the existing and consequential vacancies.

Minimum Qualification and Age Limit for : -

  1. Direct Recruitment: -

    1. Must be holder of a degree in Law granted by a Univ rsity established by Law in India and must have been enrolled as an Advocate.

    2. Must not have completed as on the last date fixed for receipt of applications, 38 years of age in the case of candidates belonging to Scheduled Caste or Scheduled Tribe and 35 years of age in the case of others.

    3. For ex-servicemen candidates, relaxation of three years in the upper age limit.

  2. Recruitment of In-service Candidates:-

    1. Must be holder of a degree in Law granted by a University established by Law in India.

    2. Must not have completed as on the last date fixed for receip t of applications, 43 years of age in the case of candidates belonging to Scheduled Caste or Scheduled Tribe and 40 years of age in the case of others.

    3. All In-service candidates having requr ed qualification working in the High Court and in the District Judiciary irrespective of their cadres are eligible to apply for the post of Civil Judge.

    4. Assistant Public Prosecutors-cum-Additional Government Pleaders who are working in the Department of Prosecutions and Government Litigation are also eligible to apply for the post of Civil Judges.

Note:1. Direct recruitment to the cadre of Civil Judges is subject to any order made under Article 16(4) o r 16(4A) of the Constitution of India, providing reservation for Scheduled Castes, Scheduled Tribes and other backward classes.

2. For direct recruitment to the cadre of Civil Judges 1% (One percent) reservation has been provided for Ort hoped ic disabled persons (persons having disability with one arm (OA)/ one leg (OL)/both legs (BL), subject to the prescribed qualifications.

NOTE:- The above classificati on has been made keeping in view the relevant Government Orders in force.

Method of Recruitment:- By direct recruitment on the basis of aggregate marks obtained in a competitive examination (Main Examination and Viva-Voce) conducted by the High Court, consisting of 3 stages i.e., (a ) Preliminary Examination, (b) Main Examination and (c) Viva -Voce. The marks secured in the Preliminary Examination is considered only for Eligibility for the Main Examination.

  1. PRELIMINARY EXAMINATION:-

    The Preliminary Examination shall be conducted by way of Objective Type Question Paper consisting of 100 marks and the syllabi for the said examina tions h all be the following, namely:-

    Part-A - Code of Civil Procedure, 1908;

    Negotiable Instrumets Act, 1981; Transfer of Property Act, 1882;

    Indian Contract Act, 18 72 ; Specific Relief Act, 196 3 ; Indian Constitu tion; an d Kamataka Rent Act, 1999.

    Part-B - Code of Crim ina l Procedure, 1973; Indian Penal code, 1860; and Indian Evidence Act , 1872.

    Part-C - General knowledge - Test of reasoning and mental ability.

  2. MAIN EXAMINATION:-

    1. Translation Paper (Maximum Marks 100)

      There will be one translation paper and the candidates will be required to translate passages in English into Kannada and Ka n n ada into English. The Passages will be from (1) Depositions, (2) Judgments and (3 ) Docu men ts.

    2. Law Paper I (Maximum Marks 100) The Code of Civil Procedure, 1908;

      The Code of Criminal Procedure, 1973; The Indian Evidence Act, 1872;

      Principles of Pleading and the Constitution of India .

    3. Law Paper II (Maximum Marks 100)

      Framing of Issues and writing of Judgments in Civil Cases.

    4. Law Paper III (Maximum Marks 100)

      Framing of Charges and writing of Judgments in Criminal cases.

  3. VIVA-VOCE (Maximum Marks 100)

    The candidates Gener al Knowledge, grasp of principles of la w and suitability for appointment as Civil Judge shall be tested.

  4. COMPUTER TEST (Maximum Marks 25)

The test of knowledge of computers shall carry maximum 25 marks and such marks secured by the candidate shall be considered for ascertaining the suitability and computer knowledge of the candidates and shall not be aggregated to the total marks obtained in the written examination and Viva-Voce.

Note: Regarding (b) and (c ), such of those candidates who desire to answer in Kannada may do so.

(e )(i ) Minimum marks for pass in the Preliminary Examination shall be 50 for candidates belonging to Scheduled Castes and Scheduled Tribes and 60 for others ."

  1. Minimum marks for pass in each paper of the Written Examination shall be 40 for candidates belonging to Scheduled Castes and Scheduled Tribes and 50 for others.

    2. Minimum marks for pass in the Viva-Voce shall be 40 for candidates belonging to Scheduled Castes and Scheduled Tribes and 50 for others.

    Provided that no candidate who has secured less than the minimum marks specified above:

    1. in any paper of the Written Examination shall be eligible for Viva-Voce.

    2. in any paper of the Main Written Examination or in viva-voce shall be eligible for appointment as Civil Judge.

(2) From among the candidates who are eligible for Viva-Voce as per sub-rule II (1) (e) (ii) of Rule 5 of the Karnataka Judicial Service (Recru itm en t) Rules, 2004 and Amendment Rules, 2011 and 2015, as far as may be, such number of ca n did a tes as is equal to 7 (seven) times the number of vacancies notified, having regard to the number of vacancies in each reserved category, selected in the order of merit, shall be called for Viva-Voce examination .

Disqualification for Appointment:- No person shall be eligible for appointment to the service -

(a ) unless he is a Citizen of India;

  1. if he is dismissed or removed from service or compulsorily retired by any High Court, Government or Statutory or Local Authority or other employer;

  2. ) if he has been convicted of an offence involving moral turpitude or who is or has been permanently debarred or disqualified by the High Court or the Union Public Service Commission or any State Public Service Commission from appearing for examinations or selections conducted by it or has been removed from its roll by any Bar Council;

  3. if any penalty or punishment has been imposed by the Bar Council or any disciplinary au thority which in the opinion of selecting authority, makes the applicant unsuitable for a judicial post;

  4. if he directly or indirectly influences the recruiting authority by any means for his candidature;

  5. if the marital status of the candidate is bigamous.

Probation:- A candidate selected will be initially on probation for two years or for extended period and the provisions of Karnataka Civil Services (Probation) Rules , 1977 , shall mutatis mutandis, apply to persons so appointed. The candidates appointed as Civil Judge, during the period of probation, shall -

  1. undergo such training for a period not less than one year or more as specified by the High Court, and

  2. pass the Kannada Language Examination conducted by the Karnataka Public Service Commission in accordance with the Karnataka Civil Services (Services and Kannada Language Examina tions) Rules, 1974, if he/ she has not already passed it.

Those who are desirous of applying for the said posts are required to fill the application online on the website http://karnatakajudiciary.kar.nic.in/recruitment. asp. Applications sent by any other mode other than online will not be considered and to remit the fee as hereunder:

  1. Online Payment: On submission of online application the candidate shall make the online payment of application fee by SBI online payment gateway to http: //www.onlinesbi.com/ prelogin/ icollecthome.htm

    Or

  2. Chal lan Form: On submission of online application the can dida te shall download the challan through the SBI online payment gateway link http://www.onlinesbi.com/ prelogin/ icollecthome. htm in PDF format and shall remit the prescribed fee in any b ran ch of SBI. (System need to support PDF reader-like Adobe, Acrobat)

    The Last Date for register/submit Online Applications: 01.03.2017 (11.59 PM)

    The Last Date for payment of fee through Challan: 04.03.2017

    1. Preliminary Examination Candidate shall remit an amount of Rs .500/- (Rupees Five hundred only) using the challan genera ted online. But, in the case of candidate belongin g to SC / ST / Category-I, the fee payable shall be Rs .250/- (Rupees Two fifty only).

(2 ) Main Examination fee shall be payable by each candidate who is successful in the Preliminary Examination and eligible to appear for the Main Examination immediately within 15 (Fifteen ) days from the date of announcing the result of the Preliminary Examination, failing which, their candidature will not be considered for Main Examination. The candidate shall remit an amount of Rs. 1000/- (Rupees One thousand only) using the challan generated online. But, in the case of candidate belonging to SC/ST/Category-I, the fee payable shall be Rs.500 - (Rupees Five hundred only).

  1. Fee once paid shall not be refunded under any circumstances.

    2. Those candidates called for Viva-Voce will have to appear before the Recruitment Committee in the premises of th e Hig h Court of Karnataka, Bengaluru, at their cost.

  2. Applications sent in any other mode except online will not be considered.

    3.The in -service candidates shall submit their applications online not later than the date and time fixed for receipt of applications and should possess the "No Objection Certificate" issued by the concerned Authority.

  3. Candidates Claiming Reservations under SC ST, Category- I/IIA/IIB/IIIA/IIIB shall possess the certificate in the form as prescribed by the Government of Karnataka, and issued by the competent Authority.

i) Candidates claiming reservation under Rural/Physically Handicapped/Ex-Servicemen/Kanna da Medium candidates shall posses the Certificates issued by Competent Authorities. General Merit ecomdidates claiming reservatiion under Rural Category shall possess Crealmy Layer Certificate.

  1. The candidates claiming benefits under Sl.No.(d),(e ) and (f) above shall possess the relevant certificates , issued by the Competent Authorities on or before the last date of applying online and to produce the same when ever directed by he Authority to do so .

  2. Candidates claiming rescrvation under Local Cadre shall possess the relevant ce:-tificate issued by the Competent Authority on or before the last day of applying onlin e as prescribed under The Karnataka Public Employment (Reservation in a ppoin tment for Hyderabad Karnataka Region) (Issue of Eligibility Certificates) Rules , 2013 and to produce the same whenever the authority directs to do so.

  3. Candidates claiming reservation under Ex-Servicemen shall possess the certificate of release or discharge from military Service and to produce the same whenever directed by the Authority to do so.

  4. The candidate shall furnish two character certificates or good character (one from the Principal of the Institution/College in which he/she last studied with study details and another from a respectable person not being a relative who is well acquainted with him/ her

  5. Candidates called for the document verification at the time of Viva-Voice shall furnish the necessary original documents with regard to Educational Qualification (SSLC or eq uivalent examination certificates to show the Date of Birth , Degree and Law Degree Convocation Certificates and Marks Cards ), Caste, reservations claimed with regard to Rural / Physically Handicapped/ Ex- Servicemen / Kannada medium and reservation claimed for " Local Ckidrc" for verification . On verification, if the information so furnished by the applicant in the application is found to be false, then their candidature is liable for rejection and also they are liable for Criminal Prosecution for furnishing false information.
